1. Agreement to Terms

By accessing or using AtMyVenue ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

2. Description of Service

AtMyVenue is an online platform that enables event organizers to create, manage, and sell tickets for events, and allows customers to discover and purchase tickets for various events.

Our services include:

  • Event listing and discovery
  • Ticket sales and distribution
  • Payment processing
  • QR code-based ticket validation
  • Event management tools for organizers
  • Customer support and communications

3. User Accounts

3.1 Account Creation

To use certain features of the Service, you must create an account. You agree to:

  • Provide accurate, current, and complete information
  • Maintain and update your information to keep it accurate
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized access
  • Be responsible for all activities that occur under your account

3.2 Account Types

AtMyVenue offers different account types:

  • Customer: Can browse events and purchase tickets
  • Event Organizer: Can create and manage events, sell tickets
  • Venue Manager: Can manage venue information and listings
  • Administrator: Platform administrative access

4. Fees and Payment

4.1 Platform Fees

AtMyVenue charges platform fees for paid ticket sales:

  • Standard Pricing: $0.65 per ticket sold
  • Charity Pricing: $0.33 per ticket sold (for approved non-profit organizations)
  • Free Events: $0.00 - No fees for free tickets

4.2 Payment Processing

Payments are processed through Stripe. By using our Service, you agree to Stripe's Terms of Service. Event organizers will receive payouts according to their configured payout schedule.

4.3 Taxes

Event organizers are responsible for determining and collecting any applicable taxes on ticket sales. AtMyVenue does not automatically calculate or collect taxes.

5. Event Organizer Responsibilities

As an event organizer, you agree to:

  • Provide accurate event information
  • Honor all tickets sold through the platform
  • Comply with all applicable laws and regulations
  • Obtain necessary permits and licenses for your events
  • Not engage in fraudulent or deceptive practices
  • Handle refunds and customer service for your events
  • Maintain adequate insurance coverage for your events
  • Not sell tickets for illegal activities or prohibited content

6. Ticket Purchases and Refunds

6.1 Ticket Purchases

When you purchase a ticket, you agree to:

  • Pay the full ticket price and any applicable fees
  • Provide accurate contact and payment information
  • Review event details before completing your purchase
  • Understand that ticket sales are subject to availability

6.2 Refund Policy

Refunds are subject to the event organizer's refund policy. AtMyVenue does not control refund policies for individual events. Contact the event organizer directly for refund requests.

In cases of event cancellation or fraud, AtMyVenue may facilitate refunds at our discretion.

7. Prohibited Activities

You agree not to:

  • Use the Service for any illegal purpose
  • Create fake accounts or impersonate others
  • Engage in ticket scalping or unauthorized resale
  • Attempt to circumvent security measures
  • Use automated systems to purchase tickets (bots)
  • Upload malicious code or viruses
  • Harvest user data without permission
  • Interfere with the proper functioning of the Service
  • Create events for illegal activities or prohibited content
  • Engage in fraudulent chargebacks

8. Intellectual Property

8.1 Our Intellectual Property

The Service and its original content, features, and functionality are owned by AtMyVenue and are protected by international copyright, trademark, and other intellectual property laws.

8.2 User Content

By uploading content to the Service (event descriptions, images, etc.), you grant AtMyVenue a worldwide, non-exclusive, royalty-free license to use, reproduce, and display your content in connection with operating the Service.

You represent that you own or have the necessary rights to the content you upload.

9. Disclaimers and Limitation of Liability

9.1 Service "As Is"

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. AtMyVenue does not warrant that the Service will be uninterrupted, secure, or error-free.

9.2 No Liability for Events

AtMyVenue is a platform connecting event organizers and attendees. We are not responsible for:

  • The quality, safety, or legality of events
  • The accuracy of event information
  • The ability of organizers to fulfill their obligations
  • Personal injury or property damage at events
  • Cancellations or changes to events

9.3 Limitation of Liability

To the maximum extent permitted by law, AtMyVenue shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses.

10. Indemnification

You agree to indemnify and hold harmless AtMyVenue, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Events you organize through the platform
  • Content you upload to the Service

11. Privacy and Data Protection

Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to the collection and use of information as described in the Privacy Policy.

12. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for any reason, including:

  • Violation of these Terms
  • Fraudulent or illegal activity
  • Abuse of the platform
  • Non-payment of fees
  • At our sole discretion

Upon termination, your right to use the Service will immediately cease. You remain liable for any outstanding obligations.

13. Dispute Resolution

13.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

13.2 Arbitration

Any dispute arising from these Terms or the Service shall be resolved through binding arbitration in accordance with the American Arbitration Association rules, except where prohibited by law.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by:

  • Updating the "Last Updated" date
  • Sending email notifications for significant changes

Your continued use of the Service after changes constitutes acceptance of the modified Terms.

These Terms constitute the entire agreement between you and AtMyVenue regarding the Service.

15.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in effect.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

15.4 Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign our rights and obligations without restriction.
